High Court cancels IGG decision to dismiss Gasasira

The High Court has canceled a decision by the Inspector General of Government dismissing a Principal Accountant in the ministry of health, Nestor Gasasira from work over allegations of corruption.

Gasasira was dismissed from office by the former IGG, Faith Mwondah.

Mwondha also ordered for the confiscation of all properties owned by Gasasira accusing him of failing to declare them as per the Leadership code.

Gasasira challenged Mwondah’s decision saying that it was contrary to the rules of natural justice.

The High Court Judge, Justice Yorokamu Bamwine has today nullified the IGG’s decision.

Bamwine ruled that Nestor Gasasira be reinstated in his position and all his properties released.

Justice Bamwine ruled that the IGG was the sole complainant and judge in deciding the matter, something that was against the provisions of the law.

The judge said the IGG’s job is to investigate cases and forward them to the courts for action without handling them single handedly.

The IGG’s office has also been ordered to pay the costs to the suit.
