Catholic Lawyers fight to save Sejusa

 

The members of Uganda Catholic Lawyers Society in pursuance of their objective of advising the government on issues to to with the law and constitution have brought to the government attention that the declaration of Gen. David Sejusa’s seat in parliament as army MP vacant was illegal. The Speaker of Parliament, Rebecca Kadaga declared Sejusa’s seat vacant after he was allegedly found of being absent in Parliament without permission contrary to article 83 (1) (d) of the constitution of Uganda and rule 101 (6) of the Parliamentary rules of procedure.

However the Uganda Catholic Lawyers argue that the declaration of Sejusa’s seat vacant was unconstitutional, null and void. Their contention is that Parliament or the Speaker of Parliament doesn’t have the powers to declare the seat of MP vacant as it was in Sejusa’s case. They say that the law reserved that role only to the High Court judge under article 86 (1) (a).

The lawyers have therefore requested the electoral commission to halt the by election intended to fill the poprpoted vacant seat of the UPDF MP gen. David Sejusa.
