Former Kampala Central MP contestant Fred Nyanzi, has petitioned the High Court to nullify the election of Muhammad Nsereko.
Nyanzi, a brother to former presidential candidate Robert Kyagulanyi Ssentamu wants the court to declare him the validly elected MP for Kampala Central and in alternative order for fresh elections.
In an election petition filed at the Civil Division of the High Court on Tuesday March 10, 2021, Nyanzi claims that there are several votes at various polling stations that were not included in the final tally sheet in addition to disfranchisement of several eligible voters.
“I am the validly elected Kampala Central MP and not Nsereko,” Nyanzi insists.
Nsereko also the incumbent area MP is sued jointly with the Electoral Commission and Kampala Central returning officer. Nyanzi filed the petition through M/S Semuyaba, Iga and Company Advocates.
Nyanzi claims that seven presiding officers deliberately made a wrong entry on the final tally sheet by positing wrong votes at respective polling station.
This Nyanzi, claims affected the final results in the return form for transmission of results to the Electoral Commission.
“The elections in the commission of Kampala Central were carried out in a way that did not comply with the Parliamentary Elections Act leading to substantial negative effect on the results,” Nyanzi argues.
Without mentioning their names, Nyanzi claims seven electoral officers committed various electoral offences by failing without lawful excuse to furnish true returns of the election to the returning officer within the time in which they were required to furnish them.
Nyanzi also purports that there was ballot stuffing, wrong posting, mathematical and arithmetical mistakes in the electoral process.
Court records indicate that Nsereko polled 16,998 while Nyanzi emerged second with 15,975 votes.
