The National Unity Reconciliation and Development Party (NURP) founder member, Moses Kibalama has appealed against a court verdict that allowed Robert Kyagulanyi to take over leadership of the party.
On Wednesday, Kibalama filed the appeal jointly with Paul Kagombe Ssimbwa at the Court of Appeal in Kampala.
The two contend that Justice Musa Ssekaana injudiciously exercised his discretion and court’s inherent powers when he joined them as applicants and condemned them to costs.
“The trial judge erred in law and fact by holding that we had crossed over to being applicants and the applicant’s lawyers were ours, whereas not,” Kibalama contends.
The two are represented by Web Advocates and Solicitors, and Mugabi Shyaka and Company advocates.
The two, therefore, seek a court order for the retrial of the matter, so that it is determined on its merits.
