Terrible: Singer Michael Ross reportedly kissed his fellow singer, Jackie Chandiru live on stage when her hubby Caleb Alaka was in ‘class’ of Club Rouge.

We have been told that Ross kissed Chandiru without knowing that her hubby was around. The kiss Ross gave Chandiru was taken by many like an enchroachment on Alaka’s territory.

Surprisingly, Singer Chandiru looked so excited when Michael Ross kissed her. We are also told that Alaka looked comfortable when Ross kissed his Chandiru.

However we suspect that Ross’ kiss to Chandiru will have an explanation when the female singer returns home to meet the celebrated lawyer. That latest that Ross has apologised to Alaka and the lawyer said ino problem’.

We suspect that things have started becoming hotter between Caleb Alaka and singer Jackie Chandru. The lawyer was seen last Saturday night during Chandiru’s Swagger night show at Club Rouge.

Chandiru and the lawyer hugged each other live on stage before Alaka resorted to cigars. Alaka is a celebrity in the legal world but he is now a new entrant in entertainment world.

We have been told also that Alaka finds it hard to stay outside in night clubs and many times he leaves Chandru and goes home.

Chandru was also overheard telling her pals that her ultimate dream is to have Alaka officially as husband and wife.

The constitutional court has stopped the trial of former LRA commander Col. Thomas Kwoyelo, the only former LRA official currently facing charges under the war crimes court.

Kwoyelo alias Latoni was in July charged in the Gulu Based International Crimes Division with several counts of murder, kidnap, destruction of property and aggravated robbery among others.

He moved to court to challenge the constitutionality of his trial yet he had applied for amnesty in 2010.

Five Justices of the Constitutional court today passed their verdict saying Kwoyelo made out a case showing that the Amnesty Commission and the Director of Public Prosecution (DPP) have not accorded him equal treatment under the Amnesty Act. The five include Amos Twinomujuni, Constance Byamugisha, Augustine Nshimye, Remmy Kasule and Stella Arach-Amoko.

They agreed with Kwoyelo that that DPP’s act of prosecuting him when others who applied for amnesty were forgiven is inconsistent with Article 21 (1) (2) of the Constitution which provides for equal treatment of all Ugandans before the law and therefore null and void.

The five justices noted that the Amnesty Act has been in existence sine 2000 and about 24 000 people have been granted amnesty including 29 people in 2011. They said Kwoyelo applied for amnesty in 2010 observing that the DPP did not give any objection and reasonable explanation why he did not sanction Kwoyelo’s application.

“The applicant acquired a legal right to be granted amnesty or pardon under the Amnesty Act like everyone else who renounces rebellion,” the judges ruled. They said it was too late for DPP to claim his constitutional independence using the applicant. They observed that the Amnesty Act was not enacted to whittle down the prosecutorial powers of DPP or interfere with his independence as the State claimed in their submission. The DPP’s powers in their view were not infringed upon by the application for amnesty.

The five justices ordered that the file be forwarded back to the lower court with direction that it must cease the trial of the applicant (Kwoyelo) forthwith.

Moments after court, a jubilant Kwoyelo was seen hugging his lawyers for the job well done. He was represented by Caleb Alaka and Francis Onyango.

Kwoleyo however has to remain in the custody of prisons official until his case comes up for termination in Gulu.

The Government has conceded that former Lord’s Resistance Army (LRA) commander Thomas Kwoyelo qualifies for amnesty, but says he applied for it when he had already been charged in court.

It is in this light, that principal state attorney Patricia Mutesi asked the panel of five judges of the Constitutional Court to adjourn the matter to 3:00pm for her to produce evidence of Kwoyelo’s late application for amnesty.

On the issue of Kwoyelo’s alleged illegal detention and torture in un authorized places, Mutesi asked court to depend on its past decision and quash it since it doesn’t require constitutional interpretation.

In their submissions to court this morning, Kwoyelo’s lawyers Caleb Alaka and John Francis Onyango asked court to declare the acts of the Director of Public Prosecution and the Amnesty Commission of refusing to grant him a certificate of amnesty as unconstitutional.

They say refusal amounts to discrimination since others under similar circumstances have been granted certificates.

Kwoyelo wants the Constitutional Court to block his trial before the International Criminal Court division at the High Court in Gulu.

He was abducted by the LRA rebels at the age of 13 while going to school and claims that his efforts to escape from the rebels were futile, remained indoctrinated and rose in the ranks like other abductees.

Kwoyelo says he was arrested in March 2009, renounced rebellion last January and applied for amnesty in March last year and produced in court in September 2010.

The Constitution provides for a pardon including amnesty in criminal matters to achieve a legitimate end.

Caleb Alak, the lawyer representing former Lord’s resistance Army rebel Timothy Kwoyelo presently facing 53 counts of war crimes comprising crimes against humanity has asked government to pronounce itself over Kwoyelo’s amnesty application.

Kwoyelo faces charges of murder, wilful killing, kidnap with intent to kill, and destruction of property during an attack he commanded in Abera village in Parabongo Sub County Amuru district in 1999 among other charges.

Alaka has demanded that government should pronounce its self on the earlier applications for Amnesty by the war crime suspect.

Alaka says he has petitioned the war crime division of the High court to compel government to state why it has not yet responded to Kwoyelo’s application for amnesty.

The lawyer disclosed that on 12th January 2010 while in Luzira prison, Kwoyelo renounced war and armed rebellion against the government which he followed by formally applying for amnesty.

Alak added the principle legal office of amnesty commission also wrote to the Director of Public Prosecution indicating that Kwoyelo qualified for amnesty.

He said amnesty commission asked the DPP to certify Kwoyelo’s application to enable him get amnesty. However, Alaka says the DPP has neither responded to the request for certification from the amnesty commission neither given a stand on the matter.

Alaka is now accusing the government of denying his client a right to fair hearing and equal treatment.

He explained that senior former LRA commanders like brigadier Sam Kolo and Kenneth Banya who like Kwoyelo where captured by the army during combat but were pardoned and granted amnesty.

Alaka wondered how government could fail to pardon and grant amnesty to a junior former rebel commander. Once granted amnesty the Kwoyelo trail would be become irrelevant.

The amnesty Act provides that the person who has been granted amnesty can longer be prosecuted for the activities to which he or she has been pardoned.
