The opposition legal minds in parliament have attacked the attorney general peter Nyombi for defending the two ministers who are accused of contempt of parliament.

The shadow attorney general Abdu Kantutu together with shadow minister for justice and constitutional affairs medard Lubega segoona told the parliamentary committee on rules discipline and privileges that the attorney general is misguiding the nation and that his advice is creating the rift between parliament and executive.

According to Kantutu, Nyombi is the one who fuelled the whole debate and therefore he has no capacity to interpreted the law.

 

He says that the executive must respect the decision of parliament because parliament is the representative of people of Uganda. He says that there is no way parliamentary decision can be categorized saying that whoever is categorizing them is just trying to hide something.

Segoona however say that parliament has powers to suspend any minister because without its input one cannot become a minister.

He also said that no one should hide behind the technicalities of the law saying that contempt of parliament is a disciplinary matter not a criminal matter.

He said that what the ministers have done is despising the rule of common sense and therefore they should be held responsible for contempt.

The members of parliament on Rules , privileges and discipline have apologized to the vice president Edward Kiwanuka Sekandi foe directing to him summons to appear the committee to enable them understand whether the refusal of two minister accused of oil bribery not to step aside was a contempt of parliament.

The mps on this committee chaired by Fox Odoi apologized to the vice president Edward kiwanuka sekandi  in a closed meeting  they had with him for 10 minutes.

Sources say that the vice president told the mps on the committee that they do not have powers to summon him as the vice president and their summons were misdirected.

Some MPs however insisted they wanted him to give his views on the issue of contempt of parliament  since he was a speaker of parliament for 15 years .

 

Soon after the vice president left the committee the chairperson Fox odoi told journalists that it was an error to summon the person of the vice president before the committee.

Odoi said that they will visit the vice president and seek his assistance in knowing the matter of contempt of parliament including the president if there is need for his intervention.

He said that by Tuesday next week the committee would have covered all the witnesses the committee invited including the Kenyan former speaker Francis ole kaparo , retire judge George kanyeihamba and renown lawyer prof . Fredrick sempebwa to interact with them on what constitutes contempt of parliament.

The Attorney General, Peter Nyombi has said the resolutions passed by Parliament asking Prime Minister Amama Mbabazi and Internal affairs minister, Hillary Onek to step aside are not binding.

In the resolutions passed by the House last month, the MPs demanded that the two ministers step down to give room for investigations into claims that they received bribes from oil companies.

Hon Nyombi told the mps today that the resolution lacked legal backing hence can not hold, insisting that the two accused did not be guilty of contempt of parliament by refusing to step down.

Earlier this week, Mbabazi and Onek gave the same vies, saying that their refusal to bow down to calls for resignation are not tantamount to contempt of Parliament.

In their views, there is no provision in the laws on contempt of Parliament hence no reason for them to step aside.

The Member of Parliament for Busiro East In wakiso district Medard segona has excused himself from the Rules , privileges and discipline committee which is now establishing whether  two ministers Hilary onek and Amama Mbabazi were not in contempt of parliament for them not to step over oil bribe scandal allegations.

Segona announced this today while this committee was meeting the Prime Minister Amama Mbabazi although he was not happy with chairperson decision  for his dismissal from the committee earlier.

Segona said that he is stepping aside from the committee as asked by the chairperson because of his earlier debate on the floor of parliament this matter under investigation to do what the prime mister should have done when asked to step down.

He said that he will love to appear before the same committee as a witness to justify why the two ministers acted in contempt of parliament.
