The High Court in Kampala has set a date on which to deliver its judgment in an election petition filed against former vice president Prof Gilbert Bukenya on allegations of electoral malpractice.

Justice Kibuuka Musoke has set 19th September as a date on which to deliver the judgment.

The judge has told both parties to tender in written submissions. Hussein Kasta Bukenya sued Prof Bukenya seeking court orders to annul Bukenya’s victory and order fresh elections.

He accuses Prof. Bukenya of bribing voters with salt, sugar and soap in exchange for votes, which action he says was against the electoral laws.

He also accuses the Electoral Commission of failing to conduct the elections in a free and fair manner as required by law.

 

Prof. Bukenya won the contested elections with 17,382 votes, while Mr Kasta came second with 4, 953 in a race that attracted five other candidates.

The setting of the day for delivering judgment comes on the heels of the dismissal of Prof Bukenya’s application by the Constitutional Court , seeking to stay his prosecution by the Anti-Corruption Court .

Former vice president Prof Gilbert Bukenya has denied allegations of electoral malpractices during parliamentary campaigns and elections for the Busiro North seat, early this year.

Prof Bukenya has told court that he beat his challenger Kasta Hussein Bukenya overwhelmingly with a difference of 12,399.

Hussein Kasta Bukenya is seeking court orders to annul Prof. Bukenya’s victory and order fresh elections. He accuses Prof. Bukenya of bribing voters with salt, sugar and soap in exchange for votes, which action he says was against the electoral laws.

He also accuses the Electoral Commission of failing to conduct the elections in a free and fair manner as required by law.

This morning Prof Bukenya has dismissed allegations of bribery saying the Shs 300, 000 he gave to Living Hope Organisation was a refund for their transport fare, since he was the one who had invited them to his home at Lwantama, Kakiri.

Bukenya has also told court that he made that contribution because the organisation had been neglected and needed assistance.

Prof. Bukenya emerged victor with 17,382 votes, while Mr Kasta came second with 4, 953 in a race that attracted five other candidates.

Kampala high court has pushed to next month the ruling of the Entebbe Municipality electoral petition.

Justice Andrew Byabashaija has adjourned the matter to the 3rd of next month to deliver his ruling after informing both parties that the ruling was not ready today.

NRM‘s Patience Mubangizi dragged the winner Mohammed Kawuma and the EC to court.

In the petition, Mubangizi contends that the election was conducted in total contravention of the electoral law which renders its outcome a nullity.

She claims that the EC failed to collect, ascertain and tally the results of the elections at 13 out of the 74 polling stations.

She adds that the election results were so grossly mismanaged that no body including the EC knows the winner.

Mubangizi now wants court to nullify Kawuma’s election and order for fresh elections or a vote recount.

Kawuma won with 10,812 votes while Mubangizi polled 8,973 votes.

Kasta Bukenya, who accuses the former Vice President Prof. Gilbert Bukenya of committing numerous electoral offences, has today admitted before court that such accusations arise from hearsay and he never personally witnessed any.

He has told the presiding judge Kibuuka Musoke of the Kampala High court that his supporters informed him that Prof Bukenya bribed voters with money, sugar, salt and other things.

He added that he never saw Prof. Bukenya transporting voters to the polling stations but his (Kasta) supporters did.

On allegations that Prof. Bukenya made malicious statements on his Busiro radio station against Kasta as a young and poor man, Kasta failed to produce evidence of the same before court.

Wandera Ogalo and Kiyemba Mutale have today represented Prof. Bukenya. MacDusmna Kabega and Enos Tumusiime appeared for the EC while Caleb Alaka and Samuel Mulindwa Muyizzi represented Kasta.

 

In his petition, Kasta accuses the EC of failing in its duty of ensuring a free and fair poll.

He wants court to nullify the said election and also compel the EC to conduct fresh elections.

Prof. Bukenya won with 17,382 votes while Kasta polled 4,953 votes.
