The fight that took place in parliament

The opposition members of parliament have today officially returned to parliament for official duties two months after the brutal incidents that happened to a number of MPs when they battled with SFC on September 27th.

Led by the leader of opposition in parliament Winnie Kiiza , opposition mps will await to be accorded time when  they will effectively elaborate on the incidents that happened at parliament in line with the constitutional amendment bill to uplift the presidential age limit from the constitution that resulted into the scuffle.

LOP Winnie Kiiza  asked the office of the speaker to allocate her time on the order paper when she will explain to the house the incidents as they happened before and after the scuffle.

Opposition MPs have criticized the government for creating new constituencies in the Country without following proper channels a situation the legislators say his forcing the institution to rubber stamp most of the state’s incompetencies.

Otafire tabled a motion on the floor of Parliament for a resolution under Article 63 of the Constitution to retrospectively prescribe the 76 constituencies .

The criticism follows the tabling of a motion by the Minister of Justice and Constitutional Affairs, Hon. Kahinda Otafiire for a resolution under Article 63 of the Constitution to retrospectively prescribe the 76 constituencies which had earlier been designated for representation in Parliament.

The motion, which was tabled, comes after the creation of new constituencies by the government and new MPs being elected to represent these constituencies without Parliament’s prescription and endorsement.

Bugweri County MP Abdu Katuntu castigated the government for operating with impunity saying that Parliament had earlier warned the government about creating the new constituencies without following the right procedure.

Katuntu said that members of the front bench need to do their work correctly and professionally for things to move on smoothly.

Aruu County MP, Samuel Odonga Otto seconded the Motion saying that if MPs have passed laws before retrospectively then they can again as well pass the current one.

“If we passed the Parliament Pension Amendment retrospectively then we can approve this Motion as well,” he said.

Obongo County MP Hassan Fungaroo Kaps said that Parliament had been turned into a place where government’s agenda is extended.

“Parliament risks becoming a rubber stamp if we keep approving the decisions made by government in this manner. That is not acceptable and this should be the last time,” he warned.

Kira municipality member of parliament, Ibrahim Semujju Nganda said that government cannot create constituencies a few days to elections and then later on say it was a mistake.

“I appeal to the government to organize themselves enough and stop blackmailing Parliament,” Semujju said.

Semujju urged the government to start doing its work because Parliament risks looking selfish by doing things in a haphazard manner.

The motion also comes after a city advocate, Andrew Tumusiime, petitioned the Constitutional Court for declarations that the 76 constituencies were not prescribed for and endorsed by Parliament as required by the Constitution.

After only 11 months since last years general elections, the MPs in Uganda’s 9th parliament want to lift a ban on presidential age limits in order to allow people aged over 75 years to contest for president. The debate follows an argument in parliament that NRM and president Museveni won last year’s elections overwhelmingly with 85% of the total votes cast (but with only 30% voter turn out). As if this debate is not enough, there is a heated campaign in parliament about the age limit clause in the National constitution ofUganda.

The argument is that if someone like president Museveni is still alive and the people still like him, the country should not be denied the opportunity to benefit from his “visionary” leadership just because the person is above 75 years!

 Some MPs argue that they want the clause deleted in order to allow people aged above 75 years to get an opportunity to ruleUganda. This campaign is being spearheaded by some NRM MPs fromBuganda. However few vocal opposition MPs in the house shout in disapproval, saying that the move will give Museveni a chance to ruleUgandafor life.

The policemen who work with opposition face to lose their jobs. A source in Uganda police have told us this evening that the inspector general of police, Kale Kayihura in a radio call message today warned that its illegal for civil servants to work with opposition members.

The source quoted Kayihura as saying that there are some police officers who leak our secrets to the members of opposition. But we are told the police’s disciplinary team is investigating the reports and the officers who would be found guilty shall lose their jobs or be demoted.

Recently the police reshuffled the policemen who were working at parliament following allegations that they were working closely with the leader of opposition Nathan Nandala Mafabi and with other opposition MPs.

Opposition MPs irrespective of their political briefs have formed an alliance in which they will sign memorandum of understanding promising to be working together. The MPs on DP, FDC, UPC, Justice Forum and the Conservative Party working under their umbrella association of opposition MPs have convened in Jinja today to reflect on their performance over the last six months in Uganda Parliament.

By the time we went to press the MPs who had arrived included Lulume Bayiga (DP), Ibrahim Semujju (FDC), Huseein Kyanjo (Jeema) and John Ken Lukyamuzi (Conservative Party) among others.

According to the programme, the MPs whose conference has been sponsored by the conservative parties in Norway will discuss the economic challenges facing Uganda and East Africa as a whole.

The opening session of the conference has been attended by opposition party presidents Dr Kizza Besigye (FDC), Norbert Mao (DP), Olara Otunnu (UPC), Ken Lukyamuzi (CP) and Asuman Basalirwa of Jeema.

The opposition legal minds in parliament have attacked the attorney general peter Nyombi for defending the two ministers who are accused of contempt of parliament.

The shadow attorney general Abdu Kantutu together with shadow minister for justice and constitutional affairs medard Lubega segoona told the parliamentary committee on rules discipline and privileges that the attorney general is misguiding the nation and that his advice is creating the rift between parliament and executive.

According to Kantutu, Nyombi is the one who fuelled the whole debate and therefore he has no capacity to interpreted the law.

 

He says that the executive must respect the decision of parliament because parliament is the representative of people of Uganda. He says that there is no way parliamentary decision can be categorized saying that whoever is categorizing them is just trying to hide something.

Segoona however say that parliament has powers to suspend any minister because without its input one cannot become a minister.

He also said that no one should hide behind the technicalities of the law saying that contempt of parliament is a disciplinary matter not a criminal matter.

He said that what the ministers have done is despising the rule of common sense and therefore they should be held responsible for contempt.
