The Government has conceded that former Lord’s Resistance Army (LRA) commander Thomas Kwoyelo qualifies for amnesty, but says he applied for it when he had already been charged in court.

It is in this light, that principal state attorney Patricia Mutesi asked the panel of five judges of the Constitutional Court to adjourn the matter to 3:00pm for her to produce evidence of Kwoyelo’s late application for amnesty.

On the issue of Kwoyelo’s alleged illegal detention and torture in un authorized places, Mutesi asked court to depend on its past decision and quash it since it doesn’t require constitutional interpretation.

In their submissions to court this morning, Kwoyelo’s lawyers Caleb Alaka and John Francis Onyango asked court to declare the acts of the Director of Public Prosecution and the Amnesty Commission of refusing to grant him a certificate of amnesty as unconstitutional.

They say refusal amounts to discrimination since others under similar circumstances have been granted certificates.

Kwoyelo wants the Constitutional Court to block his trial before the International Criminal Court division at the High Court in Gulu.

He was abducted by the LRA rebels at the age of 13 while going to school and claims that his efforts to escape from the rebels were futile, remained indoctrinated and rose in the ranks like other abductees.

Kwoyelo says he was arrested in March 2009, renounced rebellion last January and applied for amnesty in March last year and produced in court in September 2010.

The Constitution provides for a pardon including amnesty in criminal matters to achieve a legitimate end.
