Parliament has proposed to discipline the former minister of works, Abraham Byandala, for his continuous alleged assault on journalists whenever they cover the who is battling corruption related cases at the Anti- Corruption Court in Kololo.

This follows reports that Byandala again beat up NTV –journalists Denis Kabugo last Wednesday while he appeared for trail of the case.

On 23rd March 2016,  Byandala is said to have punched Ms Judith Naluggwa of Bukedde TV in the lower abdomen at the registry of the Anti-Corruption Court in Kololo, after the hearing of his case.
While discussing the matter in Parliament, the MP for Mityana Municipality, Francis Zaake, asked legislators to invoke its rules of procedure to discipline Banyandala for what he called unbecoming conduct.

Zaake said that Byandala should be sent to the Parliamentary Committee on rules, previledges and discipline to call him to order.

House Speaker, Rebeca Kadaga said that she will examine the matter and assess whether Byandala can face the disciplinary committee over his assaulting  of journalists.

The Anti-Corruption Court has fixed the 22nd October as a trial date for the 3 ministers accused of corruption.

Sam Kuteesa, John Nasasira and Mwesigwa Rukutana are accused of causing government financial loss of over 14.8 billion shillings during preparations for the 2007 CHOGM summit.

This is after both the prosecution led by Sydney Asubo and a team of 6 defense lawyers agreed on common facts and documents to be relied upon by court during the hearing.

The two parties agreed that the country was mandated to put in place requirements suitable for the visitors as the country hosted delegates from 23rd-25th November, 2007.

They further agreed that the ministry of Foreign Affairs was entrusted with all the funds to implement and co-ordinate CHOGM activities although it delegated some projects to respective ministries headed by permanent secretaries.

Among the agreed documents are the minutes of various cabinet sub-committees, contracts signed between government and 2 construction companies; Dott services and Spencon plus a Memorandum of understanding between government and Meera investments.

Court also chose and swore in 2 assessors Sarah Among and Nelson Kamiza to advise Justice Paul Mugamba on whether to convict or clear the ministers of charges of abuse of office and causing financial loss.

The 3 ministers are faulted for failing to follow up 14.8 billions shs on behalf of government as directed by the president having illegally committed government to fully fund the construction of drive ways, parking ways and rehabilitation of marinas at Munyonyo Speke resort for CHOGM visitors.

 The Anti corruption court chief magistrate Irene Akankwasa has ordered former health ministers implicated in the mismanagement of GAVI funds to pursue their appeal in the Supreme Court expeditiously so that their corruption case which continues to reflect the judicial system as a back log is cleared.

The suspects include Jim Muhwezi, Dr Alex Ka,ugisha, Mike Mukula and state house aide Alice Kaboyo.

The quartet on Tuesday appeared  before court today following criminal summons issued on 20th June requiring them to appear today for mention of their case relating to theft of 1.6 billion shillings from GAVI.

The offences are alleged to have been committed in 2006.

According to court, the purpose of the summons was to enable the suspects report the progress of their appeal in the supreme court in which they challenge the prosecuting powers of the IGG on their theft, forgery, uttering false documents and causing financial loss charges.

However, a team of 3 defense lawyers including Mac Dusman Kabega, Bob Kasango, and Fred Muwema told court that the said appeal is delayed by the constitutional court which has not yet provided them with the records to file a memorandum.

They shall re-appear in court on 4th October for mention of their case.

The former Vice President of Uganda Prof. Gilbert Bukenya has been relieved from prosecution before the anti- corruption court on charges of abuse of office till the constitutional court pronounces itself on the constitutionality of the said charges.

In his petition filed in the constitutional court, Prof Bukenya contends that the office of the VP has no independent mandate and derives all its powers from the office of the President.

He adds that whatever he did during CHOGM preparations was not personal but delivered orders from the President.

He now says that the said charges are unconstitutional since the constitution protects the President from prosecution for any actions done in an official capacity.

In their ruling areas by the constitutional court registrar Elias Kisawuzi, the 3 justices led by the deputy chief justice Mpagi Bahigeine said that the petition raises substantial constitutional issues that require resolution by the constitutional court.

They have subsequently stayed criminal proceedings against Bukenya in the Anti- corruption court till his petition is heard and determined.

The petition shall be heard on the 5th of next month.

Last month, the IGG instituted charges of abuse of office and fraudulent practice against Bukenya allegedly committed during the CHOGM preparations when he illegally issued a 9bn shs contract for motor care Uganda Ltd to buy 80 BMWs used in transporting heads of states during the event.

The anti corruption court in Kampala has finally granted a cash bail 50 million shillings cash to former Vice President Gilbert Bukenya.

Grade one Magistrate at the Nakawa based court Sarah Langa has also directed Bukenya to deposit his passport with court.

Prof Bukenya’s two sureties, Mukwaya Jessy and Henry Kawesa were also each bailed at 200 million shillings not cash.

Former Uganda President, Prof. Gilbert Bukenya

Prison stared Bukenya in face after he appeared before the magistrate and said he didn’t have the passport, which he claimed to have handed over to the government. The magistrate agreed with the prosecuting counsel that the passport could not have been withdrawn from Bukenya since he has a constitutional guarantee to continue enjoying presidential privileges.

Former Vice President Prof. Gilbert Bukenya faces charges of alleged abuse of office, in relation to the procurement of 80BMW executive cars for the 2007 Commonwealth Heads of Government Meeting in Kampala in November 2007. Bukenya insists that abuse of office charges as stated in charges absolutely not true.

Prosecution has asked for a further two weeks to complete investigations. The hearing has now been adjourned until 30 June.

The Inspectorate of Government that investigated CHOGM expenditure accused Bukenya of influencing the award of the sh9b tender to Motor care Uganda in total disregard of the laws, regulations and practices governing public procurement in Uganda.

However, Bukenya’s lawyers Macdusman Kabega and Enos Tumusiime objected to the second charge where Bukenya is jointly charged with Motorcare Uganda, arguing that it should be the company directors of Motor Care Uganda Ltd to be appear in court to answer to that charge.

Although there has been public criticism over targeting Bukenya for the CHOGM scandal charges, the Inspector General of Government Raphael Baku has said many more government or former government officials will be presented in courts of law to answer mismanagement of CHOGM funds.
