Deputy Attorney General, Mwesigwa Rukutana.

Government has tabled before Parliament a constitutional amendment bill 2017, seeking for compulsory land acquisition by government for development projects.

The was last week tabled before Parliament by the Deputy Attorney General, Mwesigwa Rukutana.

Rukutana brought the bill for its first reading a day after he told the house that the government has not drafted a bill regarding the lifting of article 102(b) for the presidential age limit of 75 years.

Some MPs tried to disrupt proceedings such as the shadow attorney General Wilfred Niwagaba who accused Rukutana of defying the Speaker’s ruling against amending the constitution in piece meal.

However, the Speaker Rt.Hon, Rebecca Kadaga, asked the house not to act in anticipation because herself has not read the contents of the bill.

She urged the house to give Rukutana an opportunity to read out the object of the bill.

She  referred the bill to the  Legal and Parliamentary Affairs Committee Chaired by  the West Budama North MP, Jacob Oboth Oboth and deputized by Gomba West MP  Robina Rwakojjo for consideration.

Fred RuhindiThe Parliamentary Appointment Committee is to vet the Attorney General and his Deputy on Thursday this week following their recent appointment by the president.

The Deputy Speaker of Parliament Jacob Oulanyah during Monday’s parliament sitting informed the house.

Fred Ruhindi will be vetted as the new Attorney General replacing Peter Nyombi whom the president dropped in the recent Cabinet Reshuffle after he had served in that capacity for only three years.

Mwesigwa Rukutana will also face the committee for possible approval as the Deputy Attorney General Rukutana has been the Minister of State for Labour.

Tokodri Tagboa appointed to be the Minister of State for Higher Education and Science and Technology will be among those that will have to prove their credentials for confirmation of their appointment by the committee

This committee chaired by the Speaker of Parliament, Rebecca Kadaga last week vetted the first group of Ministers and Presidential Appointees will vet another group of Presidential Appointees this week

Some of the appointees that the committee approved last week are the new Chief Justice Bart Katurebe and his Deputy Steven Kavuma.

Members of parliament on legal and parliamentary Affairs thrown out the committee deputy Attorney General Fred Ruhindi for failure to defend the public order management bill which is under scrutiny.

The deputy Attorney General Fred Ruhindi was asked to leave the committee when he told MPS that he wanted to first harmonize some issues in the bill which raise legalities like on the constitutional ruling of Muwanga kivumbi versus the Attorney General which said that the Inspector of police powers is regulative rather than prohibitive in relation to the exercise of freedom of assembly and peaceful demonstration.

The vice chairperson of the legal committee Baka mugabi thrown out Ruhindi on ground that the issues he was raising could propose for amendment of the bill.

The  MPS who included Abdu Katuntu , Lubega segoona ,  Stephen Baka Mugabi said that the deputy Attorney General should sit together and iron out legal and constitutional  issues in the Public order management Bill  and he comes back before the committee to defend the bill with the minister of internal Affairs who originated the bill next week.

Ruhindi said that he will return to the committee after giving legal advise to the internal Affairs minister on the bill.

The government has been urged to ratify a protocol that allows Ugandan citizens and organizations to refer cases to the African Court on Human and People’s Rights.

Only 26 out of the 54 African states have ratified the protocol and only 5 countries have made declarations, among them Burkina Faso, Mali, Ghana, Malawi and Tanzania where the court is established.

The President of the Court, Hon Justice Gerard Niyungeko says there is a gap between the main legal instrument responsible to implement and the number of states that have allowed the court to operate.

Justice Niyungeko was today meeting the Deputy Attorney General, Fred Ruhindi in a brief meeting held this afternoon in Kampala.

Niyungeko urges government to take interest and enable its people makes use of the court when they have failed to address the issues locally.
