The director of public prosecution, Mike Chibita, has asked members of parliament to include in the prevention and prohibition of human sacrifice and harmful practices bill a provision that sentences persons involved in child sacrifice to death.

Chibita made the remarks while speaking at a consultative meeting on the proposed prevention and prohibition of human sacrifice and harmful practices bill held at parliament’s conference hall organized by the parliamentary forum on children.

He said that child sacrifice has continued due to lack of a serious law, calling for a death penalty as a serious provision to send a loud message to perpetrators of child sacrifice.

He questioned that if   there is a death penalty to persons who murder adults who can defend themselves what about a child.

He also said that the bill should include a section that gives part of the assets of the offenders to the victim of crime to rehabilitate him of her.

He said that there must be a law against finding a strange child with a witchdoctor in a shrine to deter practices of child practices.

The shadow minister for Justice and constitutional Affairs Medard Sseggona says that the continuing strike by state prosecutors due to  failure by government to meet their demand for their salary hike may enhance corruption in police. Three months ago, Government asked prosecutors to call off their strike committing to meet some of their demands, which included professional allowances, salary enhancements, and tax waivers but Tuesday last week they resumed strike after government delay to respond to their complaints of low pay and poor working conditions.

He said that the police officer to give to a suspect a police bond will need to be bribed. He challenged the DPP also to join the prosecutors strike enhance their point of protesting low payment since he is the chief prosecutor.

He told the DPP to argue for bail applications for the suspects seeking for bail now as the prosecutors are still on strike. He said that he is in pain over being paid by his clients and he cannot secure bail for them.

He however supports the prosecutors strike to earn better salary so as they can purchase what is required of them.

According to the current salary structure of prosecutors under DPP, the lowest ranking state prosecutor earns a gross salary of 644, 963 shillings a month with the highest paid prosecutor at the rank of Senior Principal State Attorney taking a gross monthly pay of 2.1 million shilling.

It seems the speaker of Parliament Ms Rebecca Kadaga is in total pressure following the house’s continued investigations of corruption into Prime Minister’s office.

The Director of Public Prosecutions (DPP) told Kadaga that it was giving the country a bad image for the Public Accounts Committee of Parliament to investigate Prime Minister Amama Mbabazi. Recently the government returned some of the donor funds that reportedly went missing in Amama Mbabazi’s office.

The DPP also says that the continued investigations into the alleged swindled funds in Amama Mbabazi’s office should stop as court proceedings continue.

Sources told us that the DPP met Kadaga personally and requested her to halt the investigations. The same DPP also recently wrote a protest letter to Kadaga that the investigations into AMAMA MBABAZI’S office breach the principal of laws.

The Nakawa Magistrate court has dismissed all charges against the people who have been on remand in connection to the murder of the former inspector of Police, John Bosco Ariongo. Ariongo was hit with an object along William Street in Kampala and died on spot during a peaceful protest that was organised by the now banned Activists for Change (A4C).

The suspects who have been set free are Kaija Harod, Robert Kavuma, and Kintu Yoweri.

Others are Sharifa Nakitende, Mutwalib Abdul, Malik Nsubuga and Muhammad Sebuggwawo.

The DPP in his submission argued that the state has lost interest in the case so the dismissal.

After Col. Kiiza of Forum for Democratic Change yesterday went with other political activists such as Hajji Mubarack Munyagwa, Erias Lukwago and Muwanga Kivumbi to have lunch at Kalerwe market in Kawempe Division, other political activists walked to the offices of the DPP, Richard Butera and asked him to resign his duties.

The women activists who walked into the DPP’s office were led by ms Barbra Allimad. The activists went there to express their opinion that he deserves to resign for abusing his office by administering biased prosecution.

They told the DPP that the very honourable thing he should do for the citizens is to resign his job and pave way for better administration of justice in Uganda.

Uganda has re-arrested a Turkish man, Emmin Baro, who reportedly lured Ugandan young girls into sex. The inspector General of Uganda Police Lt. Col. Kale Kayihura confirmed to our informers that Baro has been re-arrested.

Kayihura on Thursday said that Baro, 54, is in police custody because the Director of Public Prosecution Richard Buteera protested his sentence of 6 million shillings fine or imprisonment for two years. Kayihura did not tell where Baro is detained but he said the Turkish national is liked to be charged again.

Ms Jane Kajuga Okuo says the office of the DPP called for the file of the unusual case because his office was dissatisfied with the sentence that was delivered by Nakawa Court Grade One Magistrate Rosemary Ngabirano.

The Turkish man was on March 27, charged with Computer Misuse Act under section 23(4) which provides that a person who produces child pornography commits an offence and is liable on conviction to 15 years imprisonment or a fine. Uganda says that Baro was found in possession of a compact disc with videos showing two Ugandan children sucking his genitals. Baro pleaded guilty of the offence.

The Director of Public Prosecution (DPP) Richard Butera has denied allegations by the President of Forum for Democratic Change (FDC), Col. Kiiza Besigye that he is biased.

Besigye told an opposition gathering on weekend in Jinja that parliament should pass a vote of no-confidence against Butera because the DPP is fond of imposing charges against opposition members on the directive of president Museveni/government.

Butera, however, has told news men in Kampala that he is not being used by president Museveni to fight political wars. Butera says that he imposes charges against opposition members who might have committed crimes.

He says that calls by Besigye to parliament to pass a vote of no confidence against him have no grounds. Besigye says that on several occasions Butera labeled charges against him including that of rape.

The officials of the opposition Forum for Democratic Change (FDC) who are facing treason charges in the High Court in Kampala have complained that appearing every month without trial is so costly for them as individuals and the party in general.

The officials include Ingrid Turinawe (FDC woman leader), Sam Mugumya (FDC Presidential aide), LC3 chairman for Nangabo Sub County in Wakiso district, Tony Ssempebwa, John Walakira and Patrick Mayanja and FDC youth chairman, Francis Mwijukye.

Turinamwe told court on Monday that the government is using the Directorate of Public Prosecutions (DPP) to delay their trial such that they run out of pocket.

Mugumya warned that they are about to boycott the court process if the DPP fails to complete investigations into their trial.

The Nakawa chief magistrate, Esther Namabayo adjourned the matter to April 16 for mention. The case was adjourned after the state prosecutor; Beatrice Odongo requested court to adjourn the matter to April month saying that the DPP was still compiling the facts to be used in courts against the suspects.

The government side alleges that the suspects between August and October 2011 in Kampala, Hoima, Wakiso and Mityana district planned to overthrow the NRM government by use of guns. The suspects are being represented by their lawyers Akello Patricia, and Ernest Kalibbala.

The members of Forum for Democratic Change (FDC) are smiling from west to left because their party has received $2m from German to be used in the legal battles the party is currently facing.

As we talk now FDC is battling a court case at Nakawa Chief Magistrate’s Court in which three Forum for Democratic Change (FDC) officials and others are charged with treason in connection with walk-to-work protests.

 The chief magistrate of Nakawa court, Esta Nambayo heard last week that the case was still before the Director of Public Prosecution (DPP).

Nambayo last week adjourned the case to March 12, 2012 for hearing. The three FDC officials facing treason charges include Ingrid Turinawe (FDC women league leader), Francis Mwijukye (leader of FDC youth), and Sam Mugumya (FDC president Col Kizza Besigye’s aide). Sources say that FDC is going to use the money to pay the lawyers defending its officials at Nakawa court.
