John Baptist Nambeshe, the Manjiya County MP in Bududa district

John Baptist Nambeshe, the Manjiya County MP in Bududa district says he feels sorry for Nakawa Member of Parliament, Michael Kabaziguruka whose case is to be tried in the general court martial yet he is a civilian.
Kabaziguruka had recently run to high court saying it was unfair for him as a civilian to be tried in an army court to which Justice, Patricia Basaza Wassawa in last week’s ruling dismissed.
Nambeshe says may be there is unseen circumstances that are leading him to be tried in this court martial hence having no any other option.

Prosecution alleges that Kabaziguruka aided about 20 serving officers of UPDF to plot to overthrow the government of Uganda by force of arms between February and June 2016 in the districts of Kampala, Wakiso and Luwero.

Court

The directorate of public prosecution has implored the legal parliamentary committee to probe the enormous funding inequity in the justice law and order sector. While appearing before this committee chaired by Stephen Tashobya, the deputy DPP Amos Ngolobe said that all other JLOS sector have been fully funded in case of any need but the directorate have been neglected. He said that in this financial year police received billions for manning election but for them they got nothing yet they work together in the process of prosecution.

Currently the directorate is looking for 2.5 billion shillings to recruit and promote staff but instead their budget has been cut by 400m according to the budget frame work paper. Meanwhile the directorate of public prosecution has decried the unending shortage of judges at various levels.

The director of public prosecution Michael Kibitha said that currently case backlog is beyond the capacity to handle. He explained that even key witnesses in these cases have given up because currently the available prosecutors and judges are still working on cases filed in 2012. He called on the legal committee to advocate for more judges at all levels.

Afro barometer Uganda Statistics

The 6th edition of the Afro barometer that assesses access to justice among other social services by citizens indicates that Ugandans have lost trust in the judicial sector with many reasons raised by the citizens who were interviewed in the research carried out in May this year across the country. Releasing the report findings today, the national coordinator, Afro barometer UgandaFrancis Kibirige reveals that majority of Ugandans totaling to 55% believe that officials who commit crimes often or always go unpunished and only 16% believe that ordinary citizens go unpunished.
The report continues to highlight that 75% of the citizens want parliament to continue making laws despite the decreasing trust in the institution with now 70% of Ugandans think that citizens should pay taxes and obey laws.
However the deteriorating trust among citizens towards the judicial system is attributed to case back log, expensive court processes, little or no justice delivered to Uganda, among others which has also seen many Ugandans resort to using mob justice to deal with the criminals. Many of the citizens are calling for more investment in the health and education sectors so as to improve services there to meet the needed standards.

The police have moved to crack the whip on its officers who witnessed the death of a suspected thief.

Siraj Kaweesi was killed by a mob in Kisenyi yesterday.

Those arrested over the murder include Sgt Charles Oryel, Sgt Achirie Samuel, Constables Mohammed Abdala and Konnie Lubanga.

Andrew Felix Kaweesi, the Commandant Metropolitan Police says that these will be charged with neglect of duty saying the police force does not tolerate mob justice.

Floods at a school in Uganda

From the first time a child joins school, everyone’s hope and dream is that they make it to each final level class and graduate to the next. Many resources go into this endeavour; fees, tutorials, books, pencils, advice – everything needed to have a success story. This is not a one man job – there are relatives, guardians, teachers, friends, government officials, and others that play their role, directly or indirectly, for the pupil to attain success.

Then comes D-day. A long awaited time. The day to prove worthy of all the investment put in. The first batch of pupils I will talk about woke up early in the morning, put on their uniforms – the cleanest they have ever been, got on their way to school but did not reach because the incessant rain flooded the roads rendering them impassable. The pupils miss the papers because they could not get to school. The second set of pupils, in another region of the country, made it safe to school, sat for the paper but did not get to finish because the rain disrupted the examination.

In a country where only 30% of those who enroll in Primary One reach the first final level stage (Primary Seven), according to Ministry of Education Statistics, one would think that all effort would go into making sure that the few who remain in the system are afforded every chance to excel, like making sure schools are accessible and functional in all weather. Not so it seems.

In many cases, I believe, Uganda is a self-defeating nation.

The East African Court of justice has written a tough letter to President Museveni, parliament of Uganda and to the secretary general of the East African community warning them not to send names of Uganda’s representatives to the East African Legislative Assembly until Uganda parliament makes laws that will allow all political parties with representation to parliament to send representatives.

The letter indicates that the Speaker of the East African Legislative Assembly (EALA) is not expecting any names of elected officials from Uganda until the parliament of Uganda makes rules complying with Article 50 of the East African Treaty.

The court’s letter to Uganda follows a petition which DP and its senior legal advisor, Mukasa Fred Mbidde filed in the same court, challenging the selective sending of Uganda’s representatives to EALA.

Mbidde successfully argued the case and the court ruled that each political party in Uganda with representation in parliament must send a representative to EALA.

 President Museveni and his government are to build a new prison meant to decongest Luzira Prison in Mityana district. The sources in government tell us that the new prison will cost President Museveni and his government over 8 million shillings.

Uganda Prison’s boss, Johnson Byabashaija says that the new prison will address the issue of over congestion at Luzira prison and asked the citizens to support the programme.

According to the sources in the ministry of Justice, the new prison will accommodate hardcore criminals, rebels, and capital offenders. He says that the government is also planning to build other prisons in Kasanje and Kigo.

We have been told that the government is planning to work with donors and the private sector in constructing these prisons.

The family members of people president Museveni’s government kept in prison without trial broke down in tears on Monday. This development occurred after the Luzira Prison authorities failed to produce the suspects who were arrested in 2009 to court.

The suspects were arrested in September 2009 during the three dayBuganda riots. The riots resulted following the government’s refusal of the Kabaka of Buganda and his Katikkiro to tour hiscounty ofBugerere (Kayunga district). The suspects were scheduled to appear before court today but the relatives of the suspects broke in tears when the Prison’s bus arrived without the suspects.

Only five prisoners facing minor charges such as assault and indecent assault disembarked from the Luzira prison bus. The relatives cried bitterly cursing president Museveni’s regime for denying their relatives a right to justice for three years.

The suspects include: Candida Nsubuga, Robert Sekabira, Nsubuga Kamada, Jethro Livingstone, Bashir Tyaba, Kassim Ntanzi, Salim Magoba, Paul Kikulwe, Gerald Kagga, Musa Ssengendo, Hakim Lwanga, Muzafaru Mugisha, Richard Kijjambu, Juma Sekyanzi, Adaadi Kibuuka, Sam Ssemambo, Sadat Luswata Buyungo, John Gafumba, , Joseph Katamba, Bob Kakembo, Elisa Mujuni, Mohammed Sekatawa, Meddie Nsubuga, Emmanuel Muteesaasira and Rogers Zinda.

Although FIDA-Uganda works to promote the inherent dignity and human rights of women and children using the law as a tool for social justice, it has also added on supporting homosexuals. FIDA is an organisation that is against any discrimination on whatever ground and it has struggled through using the law in order to achieve the goals of equality for all. Being women FIDA are accurately aware of the indignities, humiliation, marginalization, and powerlessness caused by discrimination on account of sex and gender. As a children-centred organisation, FIDA condemns any sexual exploitation of children by any woman or man regardless of whether it is by people of the same sex of the opposite sex.

Nevertheless, as a human rights organisation, FIDA is strongly opposed to the proposed anti homosexuality bill. In the first instance, human rights are in born and belong to all individuals equally without requiring any permission for their enjoyment. Human rights are also not conferred    by the state or by any other institution, organisation or person.

According to the press release FIDA Uganda has issued in Kampala today, it says that the proposed anti homosexuality bill is unnecessary and redundant. It says that the current criminal law for example the penal code act amendment of 2007 fully protects all children, whether boys or girls from sexual exploitation by any person who may abuse his or her position of power or authority. The penal code act already provides for the offences outlined in the homosexuality bill.

Like Tanzania relocated its capital city from Dares Salaam to Dodoma, the republic of Uganda is also planning to relocate its capital city from Kampala to Nakasongola.

Sources in government have told us that the ministers behind the idea of relocating the capital city to Nakasongola have already sold the idea to president Museveni who also seems to be supportive of the idea.

We are told some of the ministers behind the idea of relocating the capital city are Justice Minister Maj. Gen. Kahinda Otafiire and state minister for transport Stephen Cheborot.

There are also proposals that the capital should be relocated to Mbarara as the late former president of Uganda Milton Obote had planned in the past. The ministers behind the proposal argue that relocating the capital city will decongest Kampala.
