“Unfortunately, our judges in Uganda spend more time on form and not substance, on procedure and not substance” is one of the many controversial statements that President Museveni said in response to the the recent judgement on the Age-limit. In a statement released on his website, he took a swipe at the judges and boasted how the country would still be able to make constitutional changes with or without the judges casting a shadow over the relationship the Judicial arm has with the Executive.

The ruling which saw 5 judges of the Constitutional Court deliver separate judgments at the Mbale High Court denounced the increase of term of office of the current parliament to 7 years.

It remains to be seen how the Judiciary will react to this scathing attack from the President given the status of their already strained working relationship of late since the Judiciary threatened to lay down their tools over Government’s plan to beef up security of Parliament members with armored vehicles and sharp shooters. The MPs opposed to the age limit amendment sitting on the legal and parliamentary Affairs committee have accused parliament for denying them funds to carry out consultations on the presidential age limit bill.

A report read by the Kumi district MP Monica Amoding stated that failure for parliament to give the committee funds to get people’s views from regions forced them to make a minority report.

“Repealing Article 102(b) at the moment is very dangerous as it is being done for only one possible beneficiary, the current President” She noted

The proposal to amend Article 102 (b) of the Constitution seeks to promote life presidency as well as negate modern practices of constitutionalism. She said.

The MP rejected the justification that the bill was brought to comply with court orders and recommendations in the case of the former presidential candidate Amama Mbabazi Verses president Yoweri Museveni, Electoral Commission and the Attorney General in Presidential Election Petition.

Amoding stated that Article 102 (b) does not discriminate on account of age, but only a qualification like any other articles in the constitution that requires that for one to be President, he/she must be a citizen of Uganda by birth.

The fight that took place in parliament

The opposition members of parliament have today officially returned to parliament for official duties two months after the brutal incidents that happened to a number of MPs when they battled with SFC on September 27th.

Led by the leader of opposition in parliament Winnie Kiiza , opposition mps will await to be accorded time when  they will effectively elaborate on the incidents that happened at parliament in line with the constitutional amendment bill to uplift the presidential age limit from the constitution that resulted into the scuffle.

LOP Winnie Kiiza  asked the office of the speaker to allocate her time on the order paper when she will explain to the house the incidents as they happened before and after the scuffle.

Justice George Kanyeihamba has described the controversial age limit removal bill as one dividing and tearing the country into pieces.

Kanyeihamba said so while appearing before the parliamentary legal and parliamentary Affairs committee chaired by West Budama South MP Jacob Oboth-Oboth which is seeking views from different stakeholders regarding the age limit removal bill.

He said that the presidential age limit was put in the constitution for purposes of equal distribution of the national cake for different Ugandans in most parts of the country.

He asked members of parliament to love their country by rejecting this bill saying it may cause more chaos in the country.

The former Chief Justice, a member of the Constituent Assembly that drafted the 1995 constitution, warned MPs to go slow on the age limit bill because they were never elected to represent an individual but to protect all Ugandans in the country.

He said that even him at 78 years there people who tell him that he can make a good president.

He said that the bill should not be passed to benefit the current president because since 1970s he has never rested, serving in different political struggles.

The minister of state for urban Development Isaac Musumba ferried his constituents to parliament to endorse the presidential age limit bill.

This followed a resolution from leaders of the ruling National Resistance Movement in Buzaaya, Kamuli District on 14th October voting  against the removal of the presidential age limit from the Constitution.

A section of older persons came to parliament with Musumba together with a petition of 5,000 signatures petitioning him to support the age limit bill so as the president Yoweri Kagutta Museveni can get chance to stand again for presidency in 2021.

A team led by kisozi L.C3 chairperson Joseph Malandi told the minister to support the bill so as president Museveni stands in 2021 to get more development in their area.

Malandi argued that in a meeting that  resolved to oppose the age limit bill at Nawanyago Technical Institute in Buzaya county,  older persons in support of the bill were not given chance to express their views on the bill.

They thus decided to petition the minister hailing from six sub counties which including Kisozi, Nawanyago, Mbulamuti, Magago, Wankole and Bugulumbya .

While receiving the petition at parliament Buzaya county MP who is also the minister of state for Urban Development Isaac Musumba said that he will go with the decision of Buzaya county voters to support the presidential age limit bill .

President of the Conservative Party Ken Lukyamuzi says that the legal and parliamentary affairs committee should take the views on the age limit removal from the opposition seriously.

Lukyamuzi says that the leaders from the Democratic Party that s Norbert Mao, Fred Mukasa Mbidde and representatives from JEEMA appeared before the committee against the wishes of their members.

He says party members warned them against appearing before the committee because of their strong resistance against amending article 102(b) on the age limits of 35 to 75 years for presidential candidates.

Meanwhile, Mao says that although he himself had said initially that he would not appear before the committee, he changed his mind with the aim of convincing the committee to oppose the bill.

Mbidde says that there is a possibility to challenge the legality of the bill because of the violence meted on MPs on the day the motion to introduce it was moved.

He says the bill should have been subjected to people power because the quality of elections is still wanting in Uganda.

He  says that the article can be subjected to a referendum and the Bukholi county North MP Gaster Mugoya says the provision can rendered as one that can be entrenched

The committee meeting that was presided over by the vice chairperson Robinah Rwakoojo commedned the leaders for not shunning their invitation, which they agreed was a sign of tolerance and civility in multiparty politics.

Voters in Kotido district have unanimously agreed to the scrapping of the presidential age limit.  This agreement came during a consultative meeting with the area Member of Parliament Aleper Aachilla Margaret held at Kotido district church of Uganda St Philips community Centre.

The Karimajongs say that parliament should immediately pass age limit to enable president Museveni contest come 2021. The chairperson elders Forum in Kotido Loiki Paul Lonino during the meeting said that Karamoja as a region has benefited a lot from president Museveni regime.

“Museveni has lifted Karamoja region in many ways including economically, socially among others. If article 102b blocks useful persons like president Museveni, it should be immediately amended because Karamoja still needs Museveni,” Mr Lonino said adding that without Museveni, there is no Karamoja.

Adome Dominic Lokalyomoe the NRM district secretary used the platform saying that age limit discriminates people with qualities. “Age limit removal is not only targeting individuals like president Museveni but for all Ugandans who have qualities. It should be removed to allow all potential leaders to lead their people,” Lokalyomoe stressed.

“The president has done a lot in our area and he still has big plans for us like extending power to all our villages and gives us tarmac roods.We have enough security Karamojong’s are free to move from one point to another with no fear, medically we are okay. We should reward him for everything he has done for the region by supporting the removal of the age limit,” Lokwameri Nariono the chairperson veterans in Kotido added.

The district woman MP Aleper said that Karamojong’s overwhelmingly agreed to support for the removal of the age limit because of the love they have and trust in NRM party. “This is the time my people need president Museveni because he has a lot of plans for them. Am also adding my voice to the people of Kotido that parliament should remove age limit for the benefits of other Ugandans not only for the president Museveni,” the legislator said.

The legal and parliamentary Affairs committee scrutinizing the presidential age limit bill has given the medical experts two weeks to produce a report determining age impact on leadership.

The committee request came while meeting the members of the Uganda medical Association over the bill led by the Association’s president Dr.Ekwaro Obuku.

The committee chaired by Jacob Oboth had invited the medical association to help them answer the question of age in relation to the health, physical, mental fitness of someone above 75 years of age and whether such a person has ability to lead the country.

According Obuku, they have line up the team composed of pathologists, psychiatrist and psychologists to compile a comprehensive report on the body state of a 75 year old.

The Medical Association of Uganda has requested for more time to consult more experts on whether a person of over 75 years of age is fit to lead the country as a president.

However, Obuku requested that for the benefit of offering credible researched information to the committee to be allowed a period of between two to four weeks to return to the committee.

For avoidance of bias Obuku said that the association has chosen the path of using systematic reviews putting together several studies and shall not use expert opinion during their research.

The NRM group opposed to age limit removal from the constitution is up for a move to censure minister of state for investment and privatization Evelyn Anite over her plot to remove the age limit from the constitution. The anti-age limit group which include the mp for workers mp Dr.Sam Lyomoki ,Kasanda north MP Patrick Nsamba ,manjiya county mp Johnbaptist Nambeshe ,Lyemiyaga county mp Theodore Sekikubo,kumi district woman mp Monica Amoding ,mp for Buyag west Barnabas Tinkasiimire  and Dokolo south mp Felix Okot Ogong  called for disciplinary action taken against Anite for involving the army in the violation of the constitution to do away with age limit.

The Member of Parliament for Manjiya county in Bududa district John Baptist Nambeshe said that if Anite does not stop her move to abrogate the constitution  and the appointing authority is not taking action will mobilize mps  signature to censure her.

The MPs asked the UPDF to come out and speak out over this controversial issue which is   tinting their image in public.

The woman member of parliament for kumi municipality monica Amoding question whether the president in his youthful years could have been confortable seeing people amending the constitution to remove age limit.

The MP for Dokolo south Felix Okot and mp for kasanda north Patrick Nsamba  said that if the age limit removal from the constitution is right ,it should have been first cleared by the NRM party leadership and added that there a number of NRM mps opposed to the  age limit issue but are still fearing.

Lwemiya county  Thodore Sekikubo said that the group agitating for age limit removal should bring a report showing the number of each area support in the whole country  if they have a genuine cause.

jugdes-and-justiceParliament has indefinitely deferred the motion to amend the constitution to lift the age limit for judges. Parliament threw out the motion in proceedings  chaired by the speaker of parliament Rebecca kadaga which was seeking leave to cause a constitutional amendment to allow the extension of the serving age of judicial officers on the basis that the mover who is the MP for Nakifuma county Robert Kafero Sekitoleko failed to convince members on the urgency of the amendment.

Mps rejected the motion on grounds that government promised to bring other amendments on issues which were not handled by the 9th parliament including the age limit of the judicial officers. Sekitoleko faced difficulty on the floor of parliament while moving his motion when all of the MPs supposed to second the motion who include
Tororo county MP Annet Nyakecho, Kyaka south county MP Jackson Kafuzi and MP for Dokolo north Paul Muru   were rejected by the house. Kafero’s first seconder Paul Amuru was out of the country, the second person Annet Nyakecho was accused of conflict of interest since she has a court case on her election and Jackson Kafuzi was rejected since his law firm of Lwakafuzi and company advocates had clients in parliament.

Later Kafero accepted the house’s decision and pleaded that when government is bringing comprehensive constitutional amendments proposals his should be considered. Mps after rejecting this motion were seen leaving the parliamentary chambers dancing.
