High Court dismisses petition against Wakiso district Chairman Matia Lwanga Bwanika

The Kampala High court has dismissed an election petition in which NRMs Yonah Lwanga who lost the Wakiso district chairperson seat sought for court orders to nullify the victory of DP’s Matia Lwanga Bwanika for the same post.

In his ruling read by the registrar Asaph Ntegye, Justice Andrew Byabashaija has said court cannot rely on hearsay to substantiate any ground in an election petition.

The judge said that in his affidavit supporting the petition, Nsubuga stated that he never saw any malpractices committed but was only informed by his agents that there was some tampering with the ballot boxes, ballot stuffing, multiple voting and threatening of his supporters.

He also adds many of his valid votes were declared invalid and that Bwanika bribed voters with money, sugar and promising them tenders.

The said agents were kept anonymous and a few who were mentioned never swore affidavits to support Nsubuga’s claim.

Nsubuga has also been ordered to pay costs of the petition. Apart from Bwanika, Nsubuga also sued the EC blaming it for failing to ensure a free and fairelection. He had asked court to order for a recount or fresh elections.
